In this free and democratic country do we have people who are so dedicated to upholding these noble values that they will go to any lengths to shut up any form of dissent?
A couple of years ago Sandro Vella was quite closely associated with Norman Lowell. Could this have been a consequence of that association? Read the Judgement Document and express your opinion.
Justice Prevails! The sentence speaks for itself!
However, it is always a pity that such cases take so long to be resolved due to backlogs in the institution, thus leaving people in limbo about their fate. This is always to the detriment of the accused. Justice Delayed is Justice Denied!

Agree with Niccolo in that the truth prevailed, however as Ergo said, justice delayed is justice denied, so for all these years, Sandro suffered the usual persecution of "there's no smoke without fire".
Having said that, i hardly believe that those who wanted the mud to stick to him will stop here. They instituted a "non case", lost it, but are happy in the knowledge that they intimidated a man's freedom of expression.
Kudos to Sandro - always an honest man.

I wouldn't even bother going into it Malsely. The sentence speaks for itself and yet again i say Justice Prevails. So the truth ALWAYS surfaces.
Furthermore, i would be careful what is said about a court case as it may not be prudent to pass comments about court's decisions. It is known that they can institute charges against people on grounds of Disrespect towards the Courts. So Not worth it! The judgement says it all!!
This is not a case of fear but a case of prudence in my belief, so i'd rather not comment.

Norman makes a speach every 1st monday of the month, at Monday Club.
The last one, of 2nd May will soon be made available here on our Media Section.
It would be good if you could make it for next Monday Club and hear it in person, and give your feedback during the question time that follows the speach.
"meetings" per se are not planned for the moment. as Malsey said, if and when one is planned, we will let you all know.

I've just read the document, but this is insane. I'm no lawyer, but I was under the impression that one was innocent until proven guilty and that the burden of proof was on the accuser and not on the accused. This case was justice turned on its head. It was Sandro who was made to prove his innocence and not Jean Paul Mifsud to prove Sandro's guilt. I think this is unacceptable in a modern western country! You cannot take a man through two years of hell on nothing other than a "gut feeling"!

I was once told by a senior police officer that they get a lot of cases in which someone is indicated as a suspect in some crime so that the police will have the right to go search his property in the hope of finding something illegal and nailing him. I also remember Prof. Guido DeMarco saying that everybody will have something illegal in his house, knowingly or unknowingly.
So you can draw your own conclusions.
On a much more positive note I have been informed by Sandro that he will start salvaging Norman Lowell's book from the depths of his hard disk starting this weekend. Knowing Sandro, I know that he will work relentlessly to put the pieces together in the shortest possible time.

Well re the media and freedom of speech, this imposition started four years ago with the Simone Zammit Endrich case. Wonder how many have now changed their original stand seeing how things are starting to evolve in our country .

Court: Man cleared of circulating malicious email

A man from Siggiewi was yesterday cleared of circulating a malicious email about journalist Jean Paul Mifsud, with the court citing lack of evidence as being the reason for his acquittal.
YMCA chairman Jean Paul Mifsud had informed police that an email, containing defamatory content about him, was doing the rounds. He and Xarabank presenter Peppi Azzopardi made a report and said they suspected that Alessandro Vella, 25, from Siggiewi, was the man behind it.
Mr Mifsud said that Vella had an argument with the Where’s Everybody team because of programmes about Norman Lowell. Subsequently, Vella apologised to Mr Mifsud.
The police spoke to Vella and he said that he was not the author, and had in fact received the email himself. When he was asked why he had apologised, Vella said that he had done so not because he had sent the email, but because he knew about it and had not informed Mifsud.
The police said that they engaged the help of Interpol because they suspected that the email was sent from a foreign website.
When testifying in court, Mr Mifsud said that he suspected various people of sending the email, apart from Vella.
The court, presided over by magistrate Abigial Lofaro said that there was no proof to tie the accused to the case and cleared him of all charges.

Man acquitted in offensive e-mail case
A man was yesterday cleared of circulating a defamatory e-mail about YMCA chairman Jean Paul Mifsud after a magistrate ruled the charge had not been sufficiently proven.
Magistrate Abigail Lofaro cleared Alessandro Vella of circulating the e-mail on and before July 31, 2004.
She heard how the police investigated Mr Vella after they were told he had a bone to pick with Where's Everybody over a feature about Norman Lowell.
Mr Vella denied sending the e-mail although he admitted to receiving it. Police attempts to contact the Australian company that owned the site from where the e-mail was sent proved futile.
The magistrate heard PS David Agius, from the cyber crime unit, explain that evidence did not directly link Mr Vella with the e-mail address from where the message had originated.
Although, the magistrate said, it was possible and even probable that Mr Vella had sent the e-mail, the crime had not been proven to the level beyond reasonable doubt required by law.
Police Inspector Ian Abdilla prosecuted.

I don't like this comment. Somebody is still trying to throw some shit at Sandro Vella in the hope that some of it will stick.

I've just read the document, but this is insane. This was a truly vexatious case.
It shows the arrogance of these people.
Hauling someone to court on a hunch!
And the costs?
Who pays for the hours of futile investigations?
Police wasting their time instead of pursuing real criminals.

with a blatant contradiction: kumment infelici.
I was mentioned several times during the proceedings:
several times within the actual judgement.
Lowell: always him! The instigator!
But Sandro came out well!
He stood his ground, suffered much:

he knows Pericles. don't worry. Sandro is a good and decent man and has many loyal friends.
however i doubt he'd bother to go through yet another court procedure to sue some anonymous poster on another forum who is trying to misinterpret a court judgement - for no apparent valid reason.
i've seen the posts you are referring to, and i've even replied to them. i sometimes wonder what makes these kind of people tick. so sick. so morbid :(

On Thursday The Times erroneously reported the magistrate as saying "it was possible and even probable that the accused had sent the e-mail".
Magistrate Lofaro cleared Mr Vella of the charge after noting that the prosecution had failed to prove the charge to the level beyond reasonable doubt required by law.
The error is regretted.
I thought it was highly unusual a magistrate had passed such a comment!
Some "journalist" must have been really overzealous to paint Sandro Vella black to make such a "mistake".

it was not the magistrate that ruined her 10 page judgement, but the male reporter of the Times who mis-interpreted the judgement ..... then published a vague "the error is regretted".
