Voters to decide whether to deny bail to some criminal immigrants
12 May 2005
PHOENIX Arizona voters will be asked next year whether the state ought to deny bail to illegal immigrants charged with serious crimes.
A proposal that cleared the Arizona Legislature today puts the question to voters.
If approved by voters next year, the change would be written into the state's constitution.
Supporters say the proposal was needed to help prevent criminal immigrants who skip bail from committing future offenses.
It would apply to certain classes of criminal charges that include murder, sexual assault and kidnapping.
Opponents say the measure is overly broad and could apply to legal immigrants whose visas have lapsed and commit crimes such as illegally downloading music over the Internet or altering a lottery ticket.
Unlike most other proposals approved by the Legislature, this measure doesn't go to Governor Janet Napolitano for her consideration.
